1. About these Terms
These Terms govern your use of cart.ke ("the Service"), a storefront-publishing platform for Kenyan small-business sellers. By creating a store you accept these Terms.
cart.ke provides the publishing tools only. Buyers and sellers transact directly through WhatsApp; cart.ke is not a party to any transaction and does not handle payment, delivery, or after-sale disputes.
2. Your role as a seller
You are responsible for the lawfulness of the products you offer, the accuracy of every product description, the legality of every photograph (you must own or have permission to use it), and the conduct of every order conversation initiated through your storefront.
You agree to comply with the Acceptable Use Policy and the Prohibited Products list.
3. Platform conduct
We will never display another seller's products, links, recommendations, or promotional content on your storefront. We will never use your storefront URL or buyer traffic to surface other sellers, ours or any third party's. If we ever change this policy, you may terminate your subscription immediately and receive a full refund of the last 12 months of fees paid.
4. Subscription, trial, and cancellation
Your store starts in trial when you publish it for the first time. The trial lasts 14 days. After the trial, payment of the monthly subscription is required to keep your store live.
If your payment lapses (and is not renewed within the 7-day grace period), your store becomes expired and is shown to buyers as currently inactive. Your data is kept while your store is expired so you can renew and pick up where you left off. Cancellation is separate: it happens only when you choose to close your store. After cancellation you have 30 days to download your data via the in-dashboard export; after those 30 days, your store data is permanently deleted, except for a minimal record of verified payments that we must keep for tax and dispute-resolution obligations under Kenyan law. Your store handle is reserved for 12 months after cancellation — message support to re-claim it within that window.
5. Suspension
cart.ke may suspend a store for violations of the Acceptable Use Policy, the Prohibited Products list, or these Terms. Suspended stores show a "currently unavailable" notice to buyers and may be reinstated after resolution.
6. Liability and disclaimers
cart.ke provides the Service "as is." We do not warrant uninterrupted availability and are not liable for losses caused by buyer-seller disputes, delivery failures, or content posted by sellers.
7. Governing law
These Terms are governed by the laws of the Republic of Kenya. Disputes are subject to the exclusive jurisdiction of the courts of Nairobi.
